US Judge Mandates Release of Kilmar Abrego Garcia from Immigration Detention
A federal judge has ordered the immediate discharge of Kilmar Abrego Garcia from detention by ICE, finding his ongoing confinement is without legal authority.
"Since Abrego Garcia's return from wrongful detention in El Salvador, he has been taken back into custody, again without legal justification," the judge stated in her order.
The case stems from a mistaken deportation to El Salvador earlier this year, which US authorities later admitted was an error. After his return to the United States to face human smuggling allegations, he was detained in immigration detention.
In her decision, the judge pointed out that the authorities does not have a valid removal order, which prevents them from deporting Mr. Abrego Garcia "for now."
